Skillfully Handling Divorce Issues

The most high-profile family law issue is divorce, and a great deal of my practice involves advising and representing clients on some or all of the issues that arise during divorce, including the modification and enforcement of divorce decrees. These issues include:

  • Child custody and visitation: If you and your spouse have children, you will need a parenting plan that reflects the children's best interests. This is not an opportunity to punish the other spouse; it is about ensuring that the children have the best possible care.
  • Child support: Under Texas' child support formula, both the incomes of the parents are used to determine the correct support amount. Determining income can be a key issue when it comes to child support.
  • Spousal support: The family courts may, in some cases, require that one spouse support the other temporarily or permanently, depending on the circumstances of the marriage.
  • Community property division: Texas is a community property state, which means most property acquired by either spouse during the marriage belongs to both. Property division in divorce can be complicated and is not always an even split.
